Fla. dentist sues bank over embezzlement

A Florida dentist whose employee embezzled nearly $500,000 from the practice claims the bank where the employee deposited many of the checks doesn't have procedures in place to stop it from happening again.

Luis Fabelo, DDS, who has offices in Hialeah and Miami Springs, discovered that former employee Elizabeth De Leon was allegedly stealing hundreds of his checks, depositing them in Wells Fargo ATMs, and depositing the money into her own accounts, according to a story on NBCMiami.com.

Dr. Fabelo started taking a close look at his surveillance cameras when a patient said he never received credit for a payment. De Leon allegedly deleted records that would have revealed the thefts.

Police said that after De Leon stopped working for Dr. Fabelo, she committed the same fraud at another dentist's office. She is now facing charges of grand theft and organized fraud.

Dr. Fabelo said when he asked the bank to return the stolen money, it refused. He is now suing in federal court, alleging that Wells Fargo has no procedures to verify that the depositor is entitled to cash the checks. Dr. Fabelo's lawsuit also said that Wells Fargo has intentionally deprived him of his funds.
