The judge in a California lawsuit alleging that Cavitron is unsafe for open surgical procedures has denied a request by Dentsply, the maker of the ultrasonic scaler, to rehear the company's request that he dismiss the case.
On January 7, San Francisco Appeals Court Judge Ignazio Ruvolo overruled a San Francisco Superior Court's decision that dentists who purchased the scaler with periodontal uses in mind do not constitute a legitimate class of plaintiffs for the purpose of the lawsuit. The case now returns to the lower court.
