A federal judge has rejected Dentsply International's bid to overturn a $44 million jury verdict in a breach of contract case with Guidance Endodontics, according to Law360.
Guidance argued successfully that Dentsply broke a 2008 agreement to supply Guidance with endodontic tools because it wanted to weaken Guidance as a competitor.
Judge James Browning of the U.S. District Court for the District of New Mexico on July 1 rejected Dentsply's motion to set aside the jury's October verdict in which Dentsply was ordered to pay $4 million in compensatory and $40 million in punitive damages.
Dentsply believed the jury's decision was "clearly not supported by the facts in the case nor the applicable law, the company stated in a press release.
