Settlement agreement dampens Align’s Q3 results

Align Technology reported revenues of $79.3 million for the third quarter of FY2009 (end-September 30), up from $76.3 million for the same quarter a year ago.

However, settlement agreement costs related to litigation with Ormco contributed to a net loss of $49.9 million for the quarter, compared to a net profit of$4.5 million in the third quarter of FY2008. The litigation settlement costs were $69.7 million, plus royalties of $1.9 million.

Third quarter revenues were driven by sequential growth in the ortho and general practitioner channels in North America and continued adoption of Invisalign Teen worldwide, Thomas Prescott, Align president and CEO, said in a press release.
