The first lawsuit involving a claim that zinc in Procter & Gamble's denture adhesive Fixodent causes debilitating neurological injuries will go to trial June 20, AboutLawsuits.com reported.
The lawsuit, which is being heard by U.S. District Court Judge Cecilia Altonaga for the Southern District of Florida, was originally scheduled to go to trial on June 6. Both the plaintiff and defendant requested more time for the discovery phase of the litigation in December.
The plaintiffs are Marianne and Daniel Chapman of Florida, who claim that the company failed to warn consumers that Fixodent contains zinc, which can allegedly cause permanent injuries from zinc poisoning. The lawsuit charges the company with liability, negligence, intentional misrepresentation, breach of express warranty, breach of implied warranty, and violation of Florida's Deceptive and Unfair Trade Practices Act.
At least 38 denture cream lawsuits filed against Procter & Gamble and GlaxoSmithKline (GSK), which manufactures Super Poligrip, have been consolidated for pretrial proceedings in the U.S. District Court for the Southern District of Florida.
Last August, GSK announced that it will settle "the vast majority" of several hundred lawsuits filed against it that allege consumers suffered zinc poisoning and neurological disabilities after using GSK Super Poligrip denture adhesives.
