The first Fixodent lawsuit involving a claim that zinc in the denture adhesive caused the plaintiff to suffer debilitating neuological injuries will go to trial in June 2011, according to a story on aboutlawsuits.com.
The Fixodent suit was brought by Marianne and Daniel Chapman of Florida, who claim that Procter and Gamble failed to warn consumers that their denture adhesive contained zinc, which can cause permanent injuries from zinc poisoning. The lawsuit charges the company with liability, negligence, intentional misrepresentation, breach of express warranty, breach of implied warranty, and violation of Florida's Deceptive and Unfair Trade Practices Act.
At least 38 denture cream lawsuits filed against Procter and Gamble and GlaxoSmithKline (GSK) -- which manufactures Super Poligrip -- have been consolidated for pretrial proceedings in the U.S. District Court for the Southern District of Florida.
GSK reported earlier this month that it plans to settle "the vast majority" of several hundred lawsuits filed against it that allege consumers suffered zinc poisoning and neurological disabilities after using GSK Super Poligrip denture adhesives. No such settlements have been reported in Fixodent cases, and Procter and Gamble has previously indicated an intention to defend the cases.
