A New Hampshire orthodontist who was charged in December 2013 with 160 counts of Medicaid fraud has been acquitted. He was found not guilty on 45 counts, and the others were previously dropped.
Manchester dentist Nicholas Marshall, DDS, 57, had been accused of making false claims to the state Medicaid office over the past five years for various procedures, including oral exams, x-rays, extractions, and orthopedic treatment, according to a concordmonitor.com story.
Prosecutors alleged that Dr. Marshall billed the state for services that he was already receiving payment for through a lump sum treatment plan.
His attorney said the total sum in question was $781, and he said Dr. Marshall believed he had been billing the procedures correctly.
Dr. Marshall is still practicing but is no longer accepting Medicaid patients, according to his attorney.
